2nd Summit
Terms of Service
Last updated: October 15, 2026
Welcome to 2nd Summit. These terms are the agreement between you and 2nd Summit for using our website, application, and services (together, the “Platform”). By creating an account, accessing the Platform, reserving a spot, joining a membership, or clicking “Accept” or “I agree,” you agree to these terms. If you do not agree, please do not use the Platform.
Please read the sections on assumption of risk, disclaimers, limitation of liability, and disputes carefully. They limit what we are responsible for, and they require most disputes to be resolved by individual binding arbitration rather than in court or in a class action.
Who can use 2nd Summit
You must be at least 18 years old and capable of entering a binding agreement. You agree to give us accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
What 2nd Summit is — and is not
2nd Summit provides a platform that aggregates and curates activities, events, products, and community experiences intended to support social, physical, and mental wellness. Some experiences are organized by us or by a volunteer ambassador working with us. Many more are organized and run entirely by third parties — parks, clubs, studios, museums, guides, and other businesses — and we list them so you can find them.
For third-party offerings, 2nd Summit acts as a curator and directory, not as the organizer, operator, or provider. We do not control these providers and are not responsible for their services, quality, safety, staff, equipment, insurance, cancellations, or transactions. We do not verify, endorse, or guarantee them. When registration or payment happens on a provider’s website, that provider’s terms and privacy policy govern it. Any disputes related to a third-party event or service are between you and that provider.
Listings are compiled from partners, public sources, and automated tools, and may contain errors. Details change — times move, events are canceled, prices differ at the door. Please confirm the details that matter to you with the organizer.
We may modify, suspend, or discontinue any part of the Platform at any time without prior notice.
Reservations, waitlists, and cancellations
Reserving a spot holds a place for you and any guests you name. Spots are limited, and reserving is not a guarantee an experience will take place. We or an organizer may change, reschedule, or cancel an experience — for weather, safety, low turnout, or any other reason. If we cancel a paid experience we organized, we will refund what you paid us.
You are responsible for the guests you bring, including making sure they meet any age or fitness requirements, that they follow these terms, and that you have their permission to give us their details. Please cancel if you cannot make it, so someone on the waitlist can go.
Payment, seat holds, and refunds for experiences you pay for on 2nd Summit are covered by our payment terms.
Refund timing depends on when this experience starts — open your reservation for dates tied to your booking.
Cancellations receive a full refund at least 30 days before the experience, a 50% refund 14–29 days before, and no refund less than 14 days before or for no-shows. Prepaid tickets and other nonrefundable commitments may have stricter terms, shown before purchase. Special circumstances? Reach out to info@2ndsummit.com. We’re happy to review your situation and may make exceptions at our discretion.
Physical activity, health, and assumption of risk
Participation in physical, outdoor, or wellness-related activities involves inherent risks. Many experiences involve physical activity, the outdoors, altitude, uneven terrain, weather, travel, and other people, and carry risks — including injury, illness, property damage, and in rare cases death — that cannot be eliminated no matter how carefully an experience is planned.
You accept full responsibility for your own health, safety, and fitness to participate. You agree to evaluate each experience honestly against your own health and abilities, to consult a physician if you have any doubt, to bring what you need, and to follow the reasonable instructions of the ambassador or organizer. Nothing on the Platform is medical advice. Ambassadors are volunteers and community members, not our employees or agents, and not medical professionals, licensed guides, or trained rescuers unless an experience says otherwise.
You knowingly and voluntarily assume all risks associated with your participation, and you agree to release and hold harmless 2nd Summit and its officers, directors, employees, agents, ambassadors, and partners from claims arising out of your participation, to the fullest extent permitted by law. Nothing in these terms releases anyone from liability for gross negligence or willful misconduct, or from anything the law does not allow to be released. We may ask you to sign a separate waiver for certain experiences.
Meeting other members
2nd Summit helps people meet. We do not conduct background checks on members, guests, or ambassadors, and we do not verify what members say about themselves. You are responsible for your own interactions with other people you meet through the Platform, online and in person. Use good judgment, and tell us if someone makes you feel unsafe. We are not responsible for the conduct of any member, guest, or other user.
Payments and membership
Some features or experiences require payment or a membership. Prices are listed on the Platform and may change with reasonable notice. Payments are processed through third-party payment providers, and your use of those providers is subject to their terms. Refund and cancellation policies for third-party events are set by the event organizer.
A paid membership renews automatically each period until you cancel, at the price shown when you subscribe unless we notify you of a change. You can cancel anytime from your account; your benefits continue through the end of the period you have paid for. Membership fees are not pro-rated, and refund requests are handled case by case by contacting info@2ndsummit.com. Membership benefits are perks, not guarantees — we may add, change, or retire them, and member pricing or early access applies only where an experience offers it.
Messages from us
By creating an account or reserving a spot, you agree that we may contact you by email, and by text message where you have given us a phone number and agreed to texts, about your account and the experiences you reserve. Marketing messages are optional and you can stop them at any time, as described in our Privacy Policy.
User conduct
You agree not to:
- Misuse the Platform or use it for any unlawful purpose.
- Harass, threaten, discriminate against, endanger, or harm other users.
- Post misleading, defamatory, or unlawful content.
- Impersonate anyone, or misuse another member’s information.
- Use the Platform for commercial solicitation.
- Attempt unauthorized access to any part of the Platform.
- Interfere with or disrupt Platform operations, or scrape, copy, overload, or reverse engineer the Platform.
We may remove content, cancel a reservation, or suspend or terminate your account at any time if we reasonably believe you have violated these terms or put a member, a partner, or the community at risk, without prior notice and without liability to you.
User content
You keep ownership of the posts, messages, stories, photos, reviews, and other content you submit. By posting or submitting content to the Platform, you grant 2nd Summit a non-exclusive, royalty-free, worldwide license to use, display, reproduce, adapt, and distribute that content in connection with operating and promoting the Platform. You represent that you own or have the necessary rights to any content you submit. We may decline or remove content for any reason, and we are not responsible for content posted by other users.
If you send us ideas or feedback, we may use them without any obligation to you.
Photos and video are sometimes taken at experiences. If you would rather not appear in them, tell the ambassador — we will honor it.
Intellectual property
All Platform content, including the 2nd Summit name, logos, design, text, curation, and software, is owned by 2nd Summit or its licensors and may not be copied, modified, or distributed without our prior written permission. You may use the Platform for your own personal, non-commercial use.
Disclaimer of warranties
The Platform and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant any third-party experience, organizer, partner, venue, product, or user.
Limitation of liability
To the maximum extent permitted by law, 2nd Summit and its officers, directors, employees, agents, ambassadors, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Platform or participation in any activities discovered through it. Our total liability for any claim arising under these terms or relating to the Platform will not exceed $100. Some states do not allow certain limitations, so parts of this may not apply to you.
Indemnification
You agree to indemnify and hold 2nd Summit harmless from claims, damages, and reasonable legal costs arising out of your use of the Platform, your participation in an experience, the guests you bring, your content, or your breach of these terms.
Governing law and dispute resolution
These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or the Platform will first be submitted to good-faith informal negotiation by contacting info@2ndsummit.com. If the dispute is not resolved within thirty (30) days, either party may initiate binding arbitration administered under the rules of the American Arbitration Association in Denver, Colorado. Each party will bear its own costs and attorneys’ fees unless the arbitrator determines otherwise. Either party may instead bring an individual claim in small claims court if it qualifies.
You agree that any claims will be brought in your individual capacity and not as part of any class or representative action, and you and 2nd Summit each waive any right to a jury trial.
Ending this agreement
You may stop using the Platform and close your account at any time. Sections that by their nature should survive — including assumption of risk, user content, disclaimers, limitation of liability, indemnification, and dispute resolution — survive the end of this agreement.
General
These terms, together with our Privacy Policy and payment terms, are the entire agreement between you and 2nd Summit about the Platform. If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer these terms without our consent; we may transfer them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. We may send you notices by email or on the Platform.
Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you by posting the updated terms on the Platform with a revised “Last updated” date. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated terms.
